Payment, Refund and Cancellation Policy
This policy applies to the private fitness consultancy provided by Vishaarad Baveja. Contact: [email protected].
1. Price and payment
The applicable one-time price is shown on the enrolment page and again in the payment link sent to the Client. There is no subscription or automatic renewal.
Payment must be completed before Day 0, which is the first scheduled consultancy call. The payment provider may collect information required to process the transaction and may apply its own terms, privacy notice, foreign-exchange treatment or mandatory taxes. The Client will see the final amount presented by the provider before authorising payment.
2. Before Day 0
If the Client cancels before Day 0, the Client may request a full refund. If the Consultant cannot begin or must cancel the engagement before Day 0, the Client will receive a full refund.
3. After Day 0
From Day 0, the service becomes personalised and the Consultant begins reserving capacity, analysing the Client’s situation and creating individual work. Except where law requires otherwise, there is no ordinary refund merely because the Client changes their mind, does not participate, does not use the support available or does not achieve a desired result.
A refund or partial refund may still be appropriate where:
- applicable law requires it;
- the Consultant materially fails to provide the agreed service and does not remedy the failure within a reasonable time;
- the Consultant ends the engagement for a reason unrelated to the Client’s conduct, safety or breach; or
- the parties agree otherwise in writing.
Any partial refund may reasonably account for calls delivered, analysis and program work completed, materials supplied, support already provided and capacity reserved.
4. EU/UK statutory withdrawal rights
This section applies only where EU or UK consumer law gives the Client a statutory withdrawal right.
An eligible online consumer ordinarily has 14 days from concluding the contract to withdraw without giving a reason. If the Client requests that the service begin during that period, the Consultant may begin on the agreed Day 0. If the Client then withdraws after work has begun, the Consultant may deduct or charge the reasonable proportion of the service already supplied, to the extent permitted by applicable law.
If an eligible Client does not request an early start, Day 0 will be scheduled after the applicable withdrawal period. Nothing in this policy limits a mandatory statutory right.
5. Missed calls and rescheduling
The Client may ask to move a call and the Consultant will act reasonably where scheduling permits. Moving one call does not automatically move the recurring weekly schedule or extend the full engagement.
A missed call, late arrival or failure to complete agreed work does not automatically create a refund, replacement call or extension. The Consultant may offer a replacement or adjustment where reasonable, but repeated non-participation cannot keep the engagement open indefinitely.
6. Pauses
Ordinary inconsistency does not pause the service. For a genuine disruption, the parties may agree a pause in writing under the Client Terms.
Up to seven paused days may initially reduce the transition period, but the transition period will not be reduced below 23 days. A longer genuine disruption may move the overall end date by written agreement. A pause does not itself create a refund right.
7. How to cancel or request a refund
Send a clear written request to [email protected] or through the usual WhatsApp conversation. Include the Client’s name, payment email, payment date and reason for the request.
Approved refunds will normally be sent to the original payment method. Processing time depends on the payment provider and receiving bank. The Consultant will confirm the refund decision and any amount in writing.
8. Chargebacks
The Client should contact the Consultant first if a payment or refund appears incorrect. This does not remove any lawful right to contact the payment provider or card issuer.
